Auctioneers' Announcements and Notices the Day of Sale take precedence over any & all preceding announcements.
No adjustments will be made on any item for any reason whatsoever. All descriptions of merchandise are for reference only. The Buyer has the final obligation to determine ALL pertinent information concerning each item. By viewing and bidding, you are accepting the item as presented. All sales are final!
A valid credit card is required for Bidder registration on auctionburst.com. No one will be eligible to bid on any auctionburst.com auctions until a valid credit card has been submitted to and verified by auctionburst.com.
All applicable Sales Taxes shall be collected by auctionburst.com, and said taxes shall be paid to the State of Tennessee. If a buyer is Tax Exempt for reasons of Resale, Church or Charitable Organization, Industrial Use Tax Exemption, Agricultural Exemption, or any other recognized tax abatement or exemption certificate, such certificate shall be transmitted to AuctionBurst.com prior to close of the sale via scan, fax, or otherwise prior to bidding and billing. If there is no certificate on file, you will pay such taxes owed, and petition the State for a refund. No Exceptions. Out-of-State buyers without resale certificates cannot claim out-of-state delivery unless using a certified hauler (not yourself) with a legitimate bill of lading. Please, don't come in at pickup and try to bulldog around these key items. Our people are not authorized to have an emergency due to your lack of planning or documentation. If we get audited, and have to pay your sales taxes because you were going to " it when you got home", and didn't, that is not going to fly. We have done this for a ton of years, as buyers, sellers, and right snap in the middle, and we have seen, heard, and done it all. If you are going to try something cute, we are ready and willing to deal with cute. Pay your taxes, or give up the certificate. A resale number from "your cousin's decorating business" will not do. Thank you, in advance, for your cooperation in this regard.
Payment in full for all items purchased (plus 10% buyers premium, plus sales tax) by the Buyer is due at close of Sale. The Buyer's credit card registered with auctionburst.com shall be charged immediately upon the close of Auction, unless prior approval for an alternate payment method has been granted by auctionburst.com, in writing, via email, prior to the Day of Sale. We settle with our Sellers after the sale is concluded, and we must close our books as soon as possible. Unless such alternate payment method has been approved in writing, Visa or Mastercard credit/debit cards are the only methods of payment accepted by auctionburst.com. If your card is declined, we will assume that your bids are invalid, and the items will roll off to the next bidder.
All items purchased by the buyer MUST be removed on the days specified. Assistance by Company Staff is limited to making certain the goods you are picking up are, in fact, yours, and showing you where it is. No loading assistance will be offered and should never be expected--our insurance will not allow it--don't ask. Bring trucks, hand trucks, dollies, tie-downs, tarps, tools, and help, if you need it. If items are not removed within the dates and times noted, the items will be considered abandoned, and will be disposed of at the Company's discretion, regardless of payment status, no refunds for abandoned items. Communication is key to making sure this does not happen.
Shipping and/or delivery services may be available via private contractors. We recommend using licensed, bonded and insured haulers, and we can provide a list of possibilities and here it is: The Yellow Pages. This is not a function of auctionburst.com, and no warranty is express or implied concerning such services. The Bidder is responsible for requesting and confirming release of goods in writing from auctionburst.com to such Contractors prior to Day of Sale, and if your delivery people don't show up, or are late, see above rules concerning removal. If your delivery people damage others' goods, the premises, cars in the parking lot, or anything else, you are responsible if they are not insured. Rest assured, this is a fact, as they are acting as your agent. Don't send kids in a borrowed truck, it never works out. Thank you for your understanding.
Removal of items can involve inherent liability, hazard and dangers, and can involve, but are not limited to: removal of venting, water tap isolation, electrical isolation, plugs, electrical box tie-ins, moving items around other items, and the like. YOU are responsible for making sure that these risks are mitigated and that there is no damage to others' property or person associated with your removal. YOU MUST CHECK IN AND OUT PRIOR TO REMOVAL OF ANYTHING. If you buy a vent hood, and it includes a roof-mounted fan, do not remove it with a crowbar and leave a hole in the roof. That is not OK. We request that you plan ahead, as it is YOUR RESPONSIBILITY to take care of the task at hand, or hire a licensed contractor AND a hauler to do it for you.
If any of this sounds short, or mean, or whatever, it is not that we are short or mean. We just want everyone to have a good time, have the sellers sell, the buyers buy, and everyone have some fun in between. Do business with us, get used to us, and we will still be doing business thirty years from now. Our businesses have been built on relationships, and we expect our customers to be nice, tell the truth, and just simply try. If we all follow these simple rules, we will all do well.
